Agreement to Terms

By downloading, installing, or using Fren ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of Fren after such modifications constitutes acceptance of the updated Terms.

Description of Service

Fren is an AI-powered companion application that allows you to have text and voice conversations with an artificial intelligence. The AI remembers your conversations to provide a personalized experience.

Fren is designed for entertainment, companionship, and general conversation. It is not a substitute for professional advice, including but not limited to medical, legal, financial, or mental health services.

Eligibility

You must be at least 13 years old (or 16 in certain jurisdictions) to use Fren. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have read and agree to these Terms.

Your Account

To use Fren, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and complete information

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity.

Subscriptions and Payments

Free and Premium Features

Fren offers both free features and premium subscription plans. Premium features require an active subscription.

Billing

Subscriptions are billed through Apple's App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your App Store account settings.

Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple in accordance with their refund policies.

Acceptable Use

You agree not to use Fren to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm others
• Generate or distribute illegal, harmful, or offensive content
• Attempt to manipulate or exploit the AI for malicious purposes
• Reverse engineer, decompile, or attempt to extract the source code
• Interfere with or disrupt the service or servers
• Create multiple accounts to abuse free features or promotions
• Use automated systems or bots to access the service
• Infringe on intellectual property rights

User Content

You retain ownership of the content you share with Fren (your "User Content"). By using the App, you grant us a limited license to process your User Content solely for the purpose of providing the service.

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of AI-generated responses, which may occasionally be incorrect, incomplete, or inappropriate.

AI Limitations and Disclaimers

Fren uses artificial intelligence to generate responses. You acknowledge and agree that:

• AI responses are generated algorithmically and may contain errors
• Fren is not a real person and cannot form genuine emotional connections
• AI responses should not be relied upon for important decisions
• Fren is not a substitute for professional medical, legal, financial, or mental health advice
• If you are experiencing a crisis or emergency, please contact appropriate emergency services

Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Fren and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

"Fren" and associated logos are trademarks of Fren. You may not use these marks without prior written consent.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from using the App.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Fren and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

Termination

You may terminate your account at any time by deleting your account through the App settings. We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fren regarding your use of the App and supersede all prior agreements and understandings.
